1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and SOMA Insights ("Company, " "we," "us," or "our") governing your access to and use of the Dispatch platform, including any related services, features, content, and applications (collectively, the "Service").

By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Eligibility

To use the Service, you must:

  • Be at least 18 years of age
  • Be a resident of the United States
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from using the Service under applicable law

By using the Service, you represent and warrant that you meet all eligibility requirements.

3. Account Registration

3.1 Account Creation

To access the Service, you must create an account by providing accurate, current, and complete information. You agree to update your information to maintain its accuracy.

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access or security breach

You may not share your account credentials with any third party.

3.3 One Account Per Organization

Each organization may maintain one account per billing relationship. Creating multiple accounts to circumvent usage limits, trial restrictions, or for any other purpose is prohibited and may result in termination of all associated accounts.

4. Free Trial and Subscription

4.1 Free Trial

New organizations may be eligible for a 14-day free trial with the following terms:

  • Maximum of 50 cards during the trial period
  • No credit card required to start
  • Trial begins upon account creation

4.2 Automatic Billing

Upon expiration of the free trial, your payment method will be automatically charged for the subscription plan you selected. By providing payment information, you authorize us to charge your payment method on a recurring basis.

4.3 Subscription Plans

  • Essentials — $7.99/month, 50 cards/month, 2 team members
  • Starter — $29.99/month, 200 cards/month, 5 team members
  • Growth — $99.99/month, 1,250 cards/month, unlimited team members
  • Enterprise — Custom pricing, unlimited cards

4.4 Subscription Terms

  • Subscriptions renew automatically at the end of each billing period
  • You may cancel at any time through your account settings
  • Cancellation takes effect at the end of the current billing period
  • You retain access to the Service until your current billing period ends

4.5 No Refunds

All subscription fees are non-refundable. When you cancel, you will not receive a refund for any fees already paid. Your access will continue until the end of your current billing period.

4.6 Price Changes

We reserve the right to modify pricing at any time. Price changes will be communicated in advance and will apply to the next billing cycle following notice.

5. Description of Service

5.1 What We Provide

Dispatch is an AI-powered connect card processing platform for churches. The Service includes:

  • AI-powered extraction of handwritten data from scanned connect cards
  • Automatic splitting of batch PDF uploads into individual cards
  • Data review and approval workflows
  • Configurable routing rules to direct card data to appropriate teams
  • Automated email notifications to staff and follow-up contacts
  • Card template detection and field mapping

5.2 AI-Extracted Data Disclaimer

IMPORTANT: All data extracted from connect cards is produced by artificial intelligence reading handwritten and printed content. AI extraction is not guaranteed to be 100% accurate.

The Service is intended as a tool to accelerate data entry. It is:

  • Not a replacement for human review of extracted data
  • Not guaranteed to be accurate, complete, or error-free
  • Subject to variability based on handwriting quality, card condition, and scan quality

You are solely responsible for reviewing and verifying all extracted data before using it for ministry follow-up or entering it into your church management system.

6. Acceptable Use Policy

6.1 Permitted Uses

The Service is intended for processing church connect cards and related ministry data by authorized church staff.

6.2 Prohibited Uses

You agree NOT to:

Data Misuse:

  • Use extracted personal data for marketing, solicitation, or purposes unrelated to ministry
  • Sell, share, or redistribute personal data extracted through the Service
  • Upload cards or documents containing information you are not authorized to process

Technical Abuse:

  • Use automated scripts, bots, or bulk processing tools
  • Attempt to circumvent usage limits or trial restrictions
  • Reverse engineer, decompile, or attempt to derive source code
  • Interfere with or disrupt the Service's infrastructure

Account Abuse:

  • Share account credentials with unauthorized persons
  • Create multiple accounts to circumvent restrictions

6.3 Enforcement

Violation of this Acceptable Use Policy may result in:

  • Warning or temporary suspension
  • Permanent termination of your account
  • Forfeiture of any remaining subscription period
  • Legal action where appropriate

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its design, features, code, algorithms, and all associated intellectual property, is owned by SOMA Insights and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Content

You retain ownership of all content you upload to the Service, including scanned connect card images. We do not claim ownership of your data.

7.3 Feedback

Any feedback, suggestions, or ideas you provide about the Service may be used by us without obligation or compensation to you.

8. Data and Privacy

8.1 Privacy Policy

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

8.2 Data Processing

By using the Service, you acknowledge that uploaded connect card images and extracted data are processed through our AI systems. We will not:

  • Share your personal information with third parties for marketing
  • Use your organization's connect card data without consent
  • Sell your personal data

8.3 Data Handling Responsibility

Connect cards often contain sensitive personal information (names, addresses, prayer requests, etc.). You are responsible for:

  • Ensuring you have appropriate authorization to process this data
  • Handling extracted data in accordance with your church's privacy practices
  • Protecting the privacy of individuals whose data is processed through the Service

9. Disclaimers

9.1 "As Is" Service

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability or fitness for a particular purpose
  • Warranties of accuracy, reliability, or completeness of extracted data
  • Warranties of uninterrupted or error-free operation

9.2 No Professional Advice

The Service does not provide professional, legal, financial, or pastoral counseling advice. Consult qualified professionals for such matters.

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOMA INSIGHTS SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Damages arising from your use or inability to use the Service
  • Damages arising from errors in AI-extracted data

10.2 Liability Cap

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless SOMA Insights, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your handling of personal data extracted through the Service

12. Termination

12.1 Termination by You

You may cancel your subscription and close your account at any time through your account settings.

12.2 Termination by Us

We may suspend or terminate your account immediately if you:

  • Violate these Terms or our Acceptable Use Policy
  • Engage in fraudulent or illegal activity
  • Fail to pay subscription fees

12.3 Effect of Termination

Upon termination:

  • Your right to access the Service ends immediately (or at the end of your billing period for voluntary cancellation)
  • We may delete your account data after a reasonable retention period
  • Uploaded card images and extracted data may be deleted within 30 days
  • Provisions that by their nature should survive will survive termination

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing any legal claim, you agree to contact us and attempt to resolve the dispute informally for at least 30 days.

13.3 Jurisdiction

Any legal action arising from these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in these courts.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SOMA Insights regarding the Service.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.

14.4 Assignment

You may not assign or transfer these Terms without our consent. We may assign these Terms without restriction.

14.5 Modifications

We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.
